GRAYLING ZONING TOWNSHIP BOARD OF APPEALS

Regular Meeting & Public Hearing

August 15,2005

I. Meeting called to order 7:00 P.M. by chairperson Barbara Greene

II. Pledge of Allegiance

III. Roll Call: Members present: Greene, French, Joyce & Robson Absent: Jansen

IV. Approval of minutes 6-20-05 Motion to approve by Robson; support by Joyce. All Ayes, one absent. Motion carried.

Approval of minutes 7-18-05 Motion to approve by French; support by Joyce. Greene abstains due to absence. Three ayes, one abstain, one absent. Motion carried.

V. PUBLIC HEARING Chair explains the formation , powers and duties of the ZBA and the public hearing procedure to be followed. Four members were present. Chair explained that a majority of three votes is needed to take action. With four members present, a tie vote would be defeated. Variances are granted to the property, not to the owner. Appeals of zoning board decisions are made in circuit court. The process to start an appeal takes 60-90 days.

Chair reads 23.04C Requirements. Motion by Joyce; support by Robson that 23.04C has been met. Four Ayes, one absent. Motion carried.

Chair reads 21.01 Administrative Standards. Motion by Robson; support by French that 21.01has been met. Four Ayes, one absent. Motion carried.

Case #05-06 Robert Buchholz

No correspondence.

No public comment.

ZBA members discuss case. Motion by Robson to approve variance of 20-feet instead of 22-feet (garage will be 28’x26’) Support by Joyce. Robson, aye; French, aye; Greene, nay; Jansen, absent; Joyce, aye

Reasons:Robson; Not against 21.01 A thru O Consistent with 23.04 2D

French; Board has right under 23.04 C within terms & conditions.

Case #05-08 Dennis Palmer

Applicant states evidence of need.

Reasons:

Motion by Robson; support by Joyce to accept 16.10 in NRD for septic. In other zones Health Department regulations will prevail for septics and wells.
