GRAYLING CHARTER TOWNSHIP ZONING BOARD OF APPEALS
REGULAR MEETING AND PUBLIC HEARING
APRIL 18, 2011

1. Roll Call:
Present – J. Zalobsky, French, Robson, Joyce & Cox
Also Present – Paul Williams, Brian Unruh and Terry Wright

2. Chair opens meeting.
Chair explains the formation, powers and duties of the zoning board of appeals and the public procedure to be followed. All members were present. Chair explains that a majority of three votes is needed to take action. Variances are granted to the property, not to the owner Chair reads 125.3606 MCL concerning appeals. An appeal under this section shall be filed within 30 days after the zoning board of appeals certifies its decision in writing or approves the minutes of its decision. Appeals of zoning decisions are made in circuit court.

Chair reads section 23.04.1 A thru D.

Motion by Robson support by Cox that petitioner has met all four conditions & 2.B requirements. All ayes, motion carried.

Chair reads 23.04.2.

Motion by Robson support by Cox. All ayes, motion carried.

Chair reads 21.01 Administrative Standards, A thru O.

Motion by Robson support by J. Zalobsky that request meets Administrative Standards. All ayes, motion carried.

Request: Construct a 9- foot by 12-foot addition (mud room) to rear of existing residence. The closest point of construction to the river is 96-feet, requiring a variance of 104-feet
Non-conformances: Lot is undersized for NRD ( required = 80,000-sq-ft) Zoning justification: Ordinance 2003-02, Article XVI, Section 16.05.B. “Lots or property of record that are non-conforming at the time of the effective date of these regulations because of lack of size to accommodate building setbacks from the water’s edge shall be allowed to be built upon and variances shall be allowed for required setbacks upon such reasonable terms as set forth by the Zoning Board of Appeals, provided that structures be placed to best meet the objectives of the Natural Rivers Act.”

Petitioner explains request. Mud room is essential to maintenance of wooden floors.

Motion by Robson support by Cox to approve as requested. All ayes, motion carried. Request granted.
Board justification: Robson – 16.05 meets objectives of NRD.(work sheets on file)
